Authorizing the City Manager to enter into negotiations for the cooperative funding agreement with Platte County, Missouri, for trail improvements along Route 152 and McHenry Park and to report back to the council on the status of the agreement within two weeks of the effective date of this ordinance.

WHEREAS, the City of Kansas City owns a total of 838 acres more or less of property designated as parkland and currently referred to as “Mark McHenry Park”, located at the northwest corner of N. Childress and Route 152, Platte County; and

 

WHEREAS, City Resolution 140182 directed the City Manager to cause specific projects to be submitted to the Mid-America Regional Council (MARC) for federal Transportation Alternatives Program (TAP) funding and the City received a $500,000.00 TAP Grant for the construction of Route 152 Trail from McHenry Park to North Amity; and

 

WHEREAS, City Ordinance 200569 authorized condemnation and taking of private property interests for public use for the Route 152 Trail from McHenry Park to North Amity however the project stalled due to rising construction costs and lack of available matching funds; and

 

WHEREAS, the City adopted a Climate Protection and Resiliency Plan in 2022 which included goals and objectives which included investing in safe bike and pedestrian infrastructure, working towards a system of protected and connected bike lanes, greenways, and sidewalks that use universal design principles, and implement the Bike KC Master Plan, Trails KC Plan to shift trips to bicycling and walking by expanding a network of safe and accessible routes; and

 

WHEREAS, in 2024, Platte County (the “County”) applied for federal funds to complete the project within the City as this section of trail is part of a 32 mile carbon free transportation loop network connecting over half of the County’s 107,000 residents, connecting communities within Riverside, Parkville, Northmoor, and Kansas City, finishing the Route 152 Trail in Platte County, and connecting recreational and activity centers within the City and will implement the City’s goals and objectives of the Climate Protection and Resiliency Plan; and

 

WHEREAS, the County has staff that can complete the construction plans, environmental clearances, and project management at no cost to the City; and

 

WHEREAS, the County and City recognize the transportation and recreational needs of the entire area and have a long history of partnership projects such as the successfully completed carbon free transportation projects such as the Southern Platte Pass, Line Creek, and Second Creek Trail projects; and

 

WHEREAS, the County and City will share responsibilities in good faith with mutual intent for general public welfare regarding the plans heretofore set forth, the County and City consider it appropriate to memorialize certain understandings to better assure that facilities and programs developed will continue to be a sustainable and valuable resource to the community and implement the goals and vision of the Climate Protection and Resiliency, Trails KC, and Bike KC Plans; and

 

WHEREAS, the County has identified $2,000,000 of its parks and storm water sales tax for Park and Trail Improvements to match federal grants to complete portions of the Route 152 Trail in the County; and

 

WHEREAS, both parties agree that it would be efficient for the County to facilitate construction of the Trail Improvements and the City to maintain the Route 152 Trail once constructed; NOW THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

                     Section 1.  That the City Manager is hereby directed to enter into negotiations for the terms of the cooperative funding agreement with Platte County, Missouri, for trail improvements along Route 152 and McHenry Park, and to report back to the council on the status of the agreement within two weeks of the effective date of this ordinance.
