COMMITTEE SUBSTITUTE
Authorizing the City Manager to execute a petition to establish the Riverfront Community Improvement District and establishing a policy for the acceptance of partial tax parcels within the boundaries of a community improvement district.

WHEREAS, Sections 67.1401 through Section 67.1571, RSMo, otherwise known as the Missouri Community Improvement District Act, provide for the establishment of a community improvement district through the filing of a petition signed by real property owners within the proposed district’s boundaries; and
WHEREAS, some property owners in the Berkley Riverfront neighborhood contemplate submitting a petition to establish the Riverfront Community Improvement District (the “District”); and
WHEREAS, the City owns real property within the boundaries of the proposed District; and
WHEREAS, Section 74-302(d) of City Code provides that the City Manager shall not execute any petition on behalf of the City as a property owner seeking to establish a community improvement district unless authorized by the City Council; and
WHEREAS, assuming a proper petition to establish the District is filed, City Council will consider whether to establish the District; NOW, THEREFORE,
BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the City Manager is hereby authorized on behalf of the City to execute a petition to establish the Riverfront Community Improvement District.
Section 2. That the City hereby establishes and acknowledges a policy which allows the boundaries of a community improvement district (“CID”) to include less than an entire tax parcel when 100% of the property owners within the proposed CID have executed the petition to establish the CID or it is otherwise reasonable to conclude by reasonable proration of assessed value of the entire tax parcel to the portion to be included in the CID boundaries that the property owners having signed the petition collectively own more that 50% of the assessed value of the property located within the boundaries of the proposed district.
