Authorizing a $2,054,790.00 design professional services contract Amendment No. 8 to Contract No. 1394 with Carollo Engineers, Inc., for the Blue River Wastewater Treatment Plant (WWTP) Biosolids Facility project for a total contract amount of $22,602,694.77; authorizing an extension of the term for an additional 504 days for a total term of 3,059 days (8.38 years); and recognizing this ordinance as having an accelerated effective date.

WHEREAS, the City Council passed Ordinance No. 180507 on July 19, 2018, authorizing a $6,327,902.77 design professional services contract, which was executed by the City on August 15, 2018, with Carollo Engineers, Inc., for the Blue River WWTP Biosolids Facility project; and
WHEREAS, the City executed a no-cost Amendment No. 1 on August 13, 2019, to redistribute funds within the contract; and
WHEREAS, the City Council passed Ordinance No. 190815 on October 10, 2019, authorizing a $2,220,000.00 design professional services contract Amendment No. 2, which was executed by the City on November 20, 2019, for scope of services changes to add procurement phase services to the project; and
WHEREAS, the City Council passed Ordinance No. 200954 on November 12, 2020, authorizing a $5,170,000.00 design professional services contract Amendment No. 3, which was executed by the City on January 6, 2021, for construction phase services for Year 1 of the project and an extension of the term by five (5) years for a total contract term of seven (7) years; and
WHEREAS, the City executed a $2,711,325.00 Amendment No. 4 on February 14, 2022, under funding approved in Ordinance No. 200954, for construction phase services, engineering services and optional services for Year 2 of the project; and
WHEREAS, the City executed a no-cost Amendment No. 5 on April 26, 2023, to redistribute funds within the contract; and
WHEREAS, the City executed a $2,501,190.00 Amendment No. 6 on July 24, 2023, under funding approved in Ordinance No. 200954, for construction phase services, engineering services and optional services for Year 3 of the project; and
WHEREAS, the City executed a $1,617,485.00 Amendment No. 7 on April 17, 2024, under funding approved in Ordinance No. 200954, for construction phase services, engineering services and optional services for Year 4 of the project; and
WHEREAS, this proposed ordinance is for a $2,054,790.00 Amendment No. 8 construction phase services, engineering services and optional services for Year 5 of the project plus an extension of the contract’s term by 504 days for a total contract term of 3,059 days (8.38 years); NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the Director of the Water Services Department is authorized to execute Amendment No. 8 to Contract No. 1394 in the amount of $2,054,790.00, for a total contract amount of $22,602,692.77 with Carollo Engineers, Inc., for the Blue River Wastewater Treatment Plant (WWTP) Biosolids Facility project, Project No. 81000821. A copy of this amendment is on file in the office of Water Services.
Section 2. That the Director of Water Services is authorized to expend up to the sum of $2,054,790.00 from the following accounts to satisfy the cost of this amendment:

Section 3. That the Director of Water Services is authorized to extend the term of Contract No. 1394, with Carollo Engineers, Inc., for an additional 504 days for a total term of 3,059 days (8.38 years) for a total contract amount of $22,602,692.77.
Section 4. That this ordinance, relating to the design, repair, maintenance or construction of a public improvement, is recognized as an ordinance with an accelerated effective date as provided by Section 503(a)(3)(D) of the City Charter and shall take effect in accordance with Section 503, City Charter.
