Authorizing the Director of Public Works to execute a construction contract with the Kansas City Streetcar Constructors (“KCSC”) in an amount not to exceed $1,600,000.00 for construction services to support the Linwood Boulevard and Main Street Intersection Improvement Project; waiving contract solicitation and award provisions; and recognizing this ordinance as having an accelerated effective date.

WHEREAS, KCSC is already working with streetcar assets in the location of this project and is familiar with the project and the expertise required for the intersection improvements; and
WHEREAS, KCSC can provide these infrastructure improvements in a timely manner while already working on the streetcar extension in this location without requiring the City to begin a second construction project in the active streetcar corridor; and
WHEREAS, KCSC provides favorable unit prices from the existing streetcar project, offering the City more infrastructure improvement for the budget; and
WHEREAS, contracting these improvements with KCSC provides efficiency, risk management, and cost savings to the City’s constituents; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the Director of Public Works is authorized to execute a construction services contract with KC Streetcar Constructors in an amount not to exceed $1,600,000.00 for construction of intersection improvements at Linwood Boulevard and Main Street, from funds previously appropriated in Account No. AL-3522-898014-B-89008890.
Section 2. That the City Council hereby finds that KCSC has specialized and specific project experience related to the improvements to Linwood Boulevard and Main Street and public solicitation would result in increased costs and delay, and therefore, it is in the best interests of the City to waive the contract solicitation and award provisions pursuant to Section 3-35(b)(5), of the City's Code of Ordinances.
Section 3. That the Civil Rights and Equal Opportunity Department (CREO) to assure fair representation by socially and economically disadvantaged groups, approved for this project, an eighteen and seventy-six hundredths percent (18.76%) representation by Minority Owned Businesses and four and six hundredths (4.06%) representation by Women Owned Businesses.
Section 4. This ordinance is recognized as an ordinance with an accelerated effective date as provided by Section 503(a)(3)(C) of the City Charter in that it appropriates money, and shall take effect in accordance with Section 503, City Charter.
