Declaring certain real property formerly known as Belvidere Park and located at 533 Tracy Avenue and 1408 Independence Avenue, Kansas City, Missouri 64106 surplus to the City’s needs; and authorizing the City Manager to negotiate and execute a sale contract, development agreements, conveyance documents, and other documents necessary to effectuate the transfer of the properties located at 533 Tracy, 1408 Independence Avenue, and 1200 Independence Avenue to the State of Missouri for the sale and redevelopment of said properties as a new Missouri State Behavioral Health Facility.

WHEREAS, Committee Substitute for Ordinance No. 190377 called an election on November 5, 2019, for the purpose of submitting to the voters of Kansas City the question of removing from the park system the property formerly known as Belvidere Park containing approximately 15.46 acres generally located north of Independence Avenue between Tracy Avenue and the Paseo Expressway, commonly known as 533 Tracy Avenue and 1408 Independence Avenue and described as:

 

Tract 1: All of Lots 1 and 2 of ARMSTRONG’S ADDITION and all of Lots 7, 8, 9, 10 and 11 of ARMSTRONG’S ADDITION and all of Lots 37 through 48, HYAN’S AND SCOTT’S ADDITION, both subdivisions in Kansas City, Jackson County, Missouri, together with north 1/2 of vacated Belvidere Street lying adjacent thereto, the east 1/2 of the vacated alley lying west of and adjacent Lot 7, ARMSTRONG’S ADDITION, the west 1/2 of the vacated alley lying east of and adjacent Lots 1 and 2, ARMSTRONG’S ADDITION, the vacated alley lying between Lots 37-43, HYANS & SCOTT’S ADDITION, the vacated alley lying between Lots 43-48 HYANS & SCOTT’S ADDITION and Lots 7-11 ARMSTRONG’S ADDITION, and vacated Tracy Avenue lying adjacent thereto, except that part platted as Chouteau Court, a subdivision in the City of Kansas City, Jackson County, Missouri;

 

Tract 2: Lot 1, TRACY’S SUBDIVISION OF LOT NINETY-SIX (96) OF HURCK’S SUBDIVISION OF THE GUINOTTE BLUFF, an addition in Kansas City, Jackson County, Missouri; and

 

Tract 3: Lot 2, TRACY’S SUBDIVISION OF LOT NINETY-SIX (96) OF HURCK’S SUBDIVISION OF THE GUINOTTE BLUFF, an addition in Kansas City, Jackson County, Missouri

 

(together, the “Park Property”); and

 

WHEREAS, such election was held on November 5, 2019, the outcome of which supported the removal of the Park Property from the park system; and

 

WHEREAS, the City recognizes a need for the redevelopment of the Park Property, along with the need for additional mental health resources; and

 

WHEREAS, the State has expressed an interest in utilizing the Park Property for the construction and operation of a public behavioral health facility; and

 

WHEREAS, the Housing Authority of Kansas City owns the adjacent parcel located at 1200 Independence Avenue and described as:

 

All of Lots 1-3, CHOUTEAU COURT, with the vacated Tracy Avenue lying adjacent thereto, a subdivision in Kansas City, Jackson County, Missouri (hereinafter “HAKC Property”);

 

WHEREAS, the Housing Authority has had discussions about conveying the HAKC Property to the State for the purpose of the public behavioral health facility; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the Park Property described above is hereby declared surplus to the City’s needs.

 

Section 2. That the City Manager is hereby authorized to negotiate and execute sale and development agreements with the Housing Authority and the State of Missouri, by and through the Missouri Department of Mental Health, the Missouri Office of Administration, or other related entities, authorizing the transfer of the Park Property and the HAKC Property to the State for a nominal or other appropriate price for the public purpose of constructing and operating a new Missouri State Behavioral Health Facility on said properties, which shall include provision of beds for use by the City.

 

Section 3. That the City Manager is further authorized to execute any real estate or other documents needed to effectuate this transaction, including the acquisition and conveyance of the HAKC Property for a nominal fee if he deems necessary.
