COMMITTEE SUBSTITUTE
Estimating and appropriating revenues in the amount of $3,260,217.00 in the Capital Improvements Grant Fund; appropriating $4,988,791.12 from the Unappropriated Fund Balance of the Capital Improvements Fund to the Northeast Vivion Road Streetscape Improvements project; authorizing the Director of Public Works to enter into a Mitigation and Air Quality Agreement and Cost Share Second Supplemental Agreement with the Missouri Highways and Transportation Commission; designating requisitioning authority; and recognizing this ordinance as having an accelerated effective date.

WHEREAS, the Council passed Committee Substitute for Ordinance No. 140182, directing the City Manager to apply to the Mid-America Regional Council (“MARC”) for a Transportation Alternatives Program (TAP) grant for the Northeast Vivion Road Streetscape Improvements project; and
WHEREAS, the Council passed Ordinance No. 180883, accepting a Congestion Mitigation and Air Quality (CMAQ) grant, award number CMAQ-9901(437), from the Missouri Highways and Transportation Commission (the “Commission”), in the amount of $275,654.27; and
WHEREAS, the Council passed Ordinance No. 190598, appropriating $475,000.00 in TAP grant funds to the Northeast Vivion Road Streetscape Improvements project; and
WHEREAS, the Council passed Ordinance No. 200992, approving the CMAQ and Cost Share Supplemental Agreement with the Commission, under which the City would receive an additional $2,760,217.00 for the project; and
WHEREAS, in 2021, MARC re-obligated $500,000.00 in TAP grant funds from the Searcy Creek Trail Segment 2 project to the Northeast Vivion Road Streetscape Improvements project; and
WHEREAS, this ordinance estimates and appropriates $3,260,217.00 in grant revenues, including $500,000.00 in re-obligated TAP funds and $2,760,217.00 in CMAQ and Cost Share funds, to support the Northeast Vivion Road Streetscape Improvements project; and
WHEREAS, Committee Substitute for Ordinance No. 120042 authorized the City to enter into a settlement agreement with Clay County to fund road and bridge projects at a specified rate from 2013 through 2026; and
WHEREAS, the City’s share of Clay County’s road and bridge tax receipts for fiscal years 2021 through 2026 have been collected in the Capital Improvements Fund, totaling $4,988,791.12;and
WHEREAS, the City intends to use the Clay County road and bridge tax receipts collected in the Capital Improvements Fund as the local match for the Northeast Vivion Road Streetscape Improvements project; and; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That revenues in the amount of $3,260,217.00 are hereby estimated in the Capital Improvements Grant Fund to the following accounts:
26-3091-895114-479095-89008267 Northeast Vivian Rd Streetscape Imp $ 500,000.00
26-3091-895114-476474-89008267 Northeast Vivian Rd Streetscape Imp 2,745,217.00
TOTAL: $3,260,217.00
Section 2. That the sum of $3,260,217.00 is hereby appropriated from the Unappropriated Fund Balance of the Capital Improvements Grant Fund to the following account:
26-3091-895114-B-89008267 Northeast Vivian Rd Streetscape Imp $3,260,217.00
Section 3. That the sum of $4,988,791.12 is hereby appropriated from the Unappropriated Fund Balance of the Capital Improvements Fund to the following account:
26-3090-896124-B-89008267 Northeast Vivion Rd Streetscape Imp $4,988,791.12
Section 4. That the Director of Public Works is hereby authorized to enter into a Mitigation and Air Quality Agreement and Cost Share Second Supplemental Agreement with the Missouri Highways and Transportation Commission. A copy of the agreement is on file with the Public Works Department.
Section 5. That the Director of Public Works is hereby designated the requisitioning authority for Account Nos. 26-3091-895114-B and 26-3090-896124-B.
Section 6. That this ordinance, being an ordinance relating to the appropriation of money and the expenses of government, is hereby recognized as having an accelerated effective date pursuant to Sections 503(a)(3)(b) and 503(a)(3)(c) of the City Charter and shall take effect in accordance with Section 503 of the Charter.
