Approving the 2026 Annual Action Plan for the Community Development Block Grant (CDBG), HOME Investment Partnership Program (HOME), the Emergency Solution Grant (ESG), and Housing Opportunities for Persons with AIDS (HOPWA); and including reprogramming funds from CDBG 2021-2024 in the amount of $2,470,098.59 and HOME 2019-2024 in the amount of $4,337,410.37; and authorizing submittal to the US Department of Housing and Urban Development.

WHEREAS, the City of Kansas City has included the four grant programs CDBG, HOME, ESG and HOPWA funding to submit to the U.S. Department of Housing and Urban Development, Community Development Block Grant program for their consideration to provide public services, public facilities, minor home repair, elimination of blight and acquisition, housing renovation and construction and assistance to those persons with AIDS and to finance the City's community development and housing programs; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

Section 1. That the 2026 Annual Action Plan is prepared pursuant to the National Affordable Housing Act of 1990, as attended, a copy of which in substantial form is attached hereto, is hereby approved.

 

Section 2. That the Mayor, on behalf of the City of Kansas City, Missouri is hereby authorized to execute and submit the aforesaid 2026 Action Plan upon notice of entitlement funding levels through the Housing and Community Development Department.

 

Section 3. That the City Council hereby certifies that the 2026 Action Plan has been prepared and will be submitted to the U.S. Department of Housing and Urban Development pursuant to and in accordance with the Department's rules and regulations, including but not limited to Title 24 Section 570.301 through and including 570.306 of the Code of Federal Regulations.

 

Section 4. That the Director of Housing and Community Development  Department is hereby authorized to expend up to a total of  $2,470,098.59 from funds previously appropriated to the Community Development Block Grant in Account No. 27-2600-575311-B-G57CDBG21 for $97,104.43; Account No. 27-2600-555324-B-G55CDBG22 for $482,843.62; Account No. 27-2600-555311-B-G55CDBG22 for $44,015.09; Account No. 27-2600-555311-B-G55CDBG23 $668,960.09; Account No. 27-2600-555320-B-G55CDBG24 $1,139,290.03; Account No. 27-2600-555311-B-G55CDBG24 $37,885.33.

Section 5. That the sum of $1,004,668.33 is hereby appropriated from the Unappropriated Fund Balance to the following accounts in the HOME Investment Partnership Program fund:

Section 7. That the Director of the Housing and Community Development Department is directed to negotiate and execute a funding agreement that provides for compliance with any applicable provisions of the Missouri Prevailing Wage Law and any applicable provisions of the City's Contracting Program Requirements set out in Article I V, Chapter 3, Code of Ordinances, including, but not limited to, the provisions concerning affirmative action, Minority and Women's Business Enterprises and the Small Local Business Enterprises program. Further, the Director of the Housing and Community Development Department is directed to negotiate a funding agreement that prohibits the use of any CDBG funding for the repayment of any preexisting debt or repayment for services or work performed prior to the execution of the funding agreement. In addition, the Director of the Housing and Community Development Department is directed to negotiate a funding agreement that requires the disclosure of total project funding sources and projected costs and periodic reporting of project progress.
