Authorizing the City Manager to exercise the option to purchase and accept a special warranty deed from Holy Ghost New Testament Church for the property located at 1815 Paseo, Kansas City, Missouri; reducing appropriations in the amount of $340,000.00 from the Capital Improvements Fund; appropriating $340,000.00 from the Unappropriated Fund Balance of the Capital Improvements Fund for the purpose of acquiring Holy Ghost New Testament Church; designating requisitioning authority; and recognizing this ordinance as having an accelerated effective date.

WHEREAS, the Holy Ghost New Testament Church at 1815 Paseo, Kansas City, Missouri (the “Church”) is located within the 18th and Vine District carries a great deal of historic cultural significance; and

 

WHEREAS, in recent years, the Church has fallen into disrepair and needs substantial restoration work; and

 

WHEREAS, in order to preserve this historic and cultural asset and eliminate blighting influences on the surrounding area, the City seeks to acquire the Church; and

 

WHEREAS, the Holy Ghost New Testament Church, a Missouri nonprofit corporation, granted the City an option to purchase the Church for $300,000.00; and

 

WHEREAS, the City completed Phase I environmental site assessment, recommending asbestos and hazardous waste abatement and a Phase II environmental site assessment, valued at approximately $40,000.00; and

 

WHEREAS, the City now seeks to exercise its option to purchase said property for $300,000.00; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager is authorized to exercise the City’s option and accept a special warranty deed from Holy Ghost New Testament Church for the following real property (hereinafter the “Property”):

 

Lots 68 and 69, Block 3, except the west 25 feet in the Paseo, H. W. Armfield’s Addition, a subdivision in Kansas City, Jackson County, Missouri, according to the recorded plat thereof (commonly known as 1815 Paseo, Kansas City, MO 64108; Jackson County Parcel No. 29-620-11-07-00-0-00-000).                     

 

Section 2. That the appropriation in the following account of the Capital Improvements Fund, Fund No. 3090, is hereby reduced by the following amount:

Section 3. That the sum of $340,000.00 is hereby appropriated from the Unappropriated Fund Balance of the Capital Improvements Fund, Fund No. 3090, to the following account:

Section 4. That the City Manager or his designee is authorized a maximum expenditure of $340,000.00 from Account No. 26-3090-578306-619850-571815PASEO for the purchase of the Property, payment of related closing costs, and payments related to further environmental testing and abatement.

 

Section 5. That this ordinance relating to the appropriation of money and the expenses of government is recognized as an ordinance with an accelerated effective date as provided by Section 503(a)(3)(C) of the City Charter and shall take effect in accordance with Section 503, City Charter.
