Accepting a $5,000,000.00 grant from the U.S. Environmental Protection Agency (“EPA”) to fund the Kansas City Organic Waste Improvement Project from March 1, 2026, through February 28, 2029; authorizing an agreement with the EPA to administer such grant; estimating and appropriating $5,000,000.00 in the General Grants Fund; authorizing cooperative agreements with Kanbe’s Markets ($1,500,000), Pete’s Garden ($400,000), Urban Produce Push ($400,000), KC Can Compost ($800,000), Bridging the Gap ($200,000), Missouri Organic Recycling ($800,000) and Compost Collective KC ($400,000) to implement such grant; and recognizing this ordinance as having an accelerated effective date.

WHEREAS, the U.S. Environmental Protection Agency seeks to enter into a Cooperative Agreement with the City of Kansas City, Missouri’s Neighborhood Service Department’s Office of Environmental Quality (“OEQ”) to provide financial support in the form of a fixed grant award to fund a program through the Solid Waste Infrastructure for Recycling Grant Program, and
WHEREAS, increasing food rescue and diverting organic waste from the landfill contributes towards the City of Kansas City, Missouri’s efforts to achieve carbon neutrality, food security, and meet additional goals outlined in the Climate Protection & Resiliency Plan, and
WHEREAS, the Food section of the Climate Protection & Resiliency Plan specifically contains Strategy F-2: Improve healthy and sustainable food access, and the Waste & Materials section specifically contains Strategy W-2: Divert organic waste from the landfill through composting, and
WHEREAS, the Cooperative Agreement between the City of Kansas City, Missouri, Office of Environmental Quality and the U.S. Environmental Protection Agency awarded the OEQ a fixed sum of $5,000,000.00 to expand both food rescue and waste diversion; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY
Section 1. That the Director of Neighborhood Service Department is authorized to accept a $5,000,000.00 grant from the U.S. Environmental Protection Agency to fund the Kansas City Organic Waste Improvement Project from March 1, 2026, through February 28, 2029 that will significantly expand the City’s capacity for food rescue, composting, and organic waste diversion by investing in infrastructure, equipment, and partnerships with local nonprofits and businesses. That the Director of Neighborhood Services Department is authorized to execute a grant agreement with the U.S. Environmental Protection Agency to govern administration of the grant. A copy of the grant agreement, identified as 96725301, is on file in the office of the Director of Neighborhood Services Department and is incorporated herein by reference.
Section 2. That the revenue in the following account of the General Grants Fund is estimated in the following amount:

Section 3. That $5,000,000.00 is appropriated from the Unappropriated Fund Balance of the General Grants Fund as follows:

Section 4. That the Director of Neighborhood Services Department is authorized to execute, on behalf of the City, a Cooperative Agreement with Kanbe’s Markets in the amount of $1,500,000.00. The agreement is approved in substantial form, as that on file with the City Clerk.
Section 5. That the Director of Neighborhood Services Department is authorized to execute, on behalf of the City, a Cooperative Agreement with Pete’s Garden in the amount of $400,000.00. The agreement is approved in substantial form, as that on file with the City Clerk.
Section 6. That the Director of Neighborhood Services Department is authorized to execute, on behalf of the City, a Cooperative Agreement with Urban Produce Push in the amount of $400,000.00. The agreement is approved in substantial form, as that on file with the City Clerk.
Section 7. That the Director of Neighborhood Services Department is authorized to execute, on behalf of the City, a Cooperative Agreement with KC Can Compost in the amount of $800,000.00. The agreement is approved in substantial form, as that on file with the City Clerk.
Section 8. That the Director of Neighborhood Services Department is authorized to execute, on behalf of the City, a Cooperative Agreement with Bridging the Gap in the amount of $200,000.00. The agreement is approved in substantial form, as that on file with the City Clerk.
Section 9. That the Director of Neighborhood Services Department is authorized to execute, on behalf of the City, a Cooperative Agreement with Missouri Organic Recycling in the amount of $800,000.00. The agreement is approved in substantial form, as that on file with the City Clerk.
Section 10. That the Director of Neighborhood Services Department is authorized to execute, on behalf of the City, a Cooperative Agreement with Compost Collective KC in the amount of $400,000.00. The agreement is approved in substantial form, as that on file with the City Clerk.
Section 11. That the Director of Neighborhood Services Department is hereby designated as requisitioning authority for Account Nos. 27-2580-575215-601100-G57EPASWIR26, 27-2580-575215-619080-G57EPASWIR26, 27-2580-575215-621100-G57EPASWIR26 and 27-2580-575215-634950-G57EPASWIR26 and is authorized to expend the sum of $5,000,000.00 from funds appropriated to Account No. 27-2580-575215, consistent with the purposes and terms of the grant agreement referenced in Section 1
Section 12. That this ordinance is recognized as an ordinance with an accelerated effective date as provided by Section 503(a)(3)(C) of the City Charter in that it appropriates money and shall take effect in accordance with that section.
