RESOLUTION - Directing the City Manager to submit proposed resolution(s) to the City Council whenever the City anticipates acceptance of grants which require matching funds in excess of one million dollars to be provided out of capital improvement sales tax funds or from general obligation bond funds; and defining specific instances wherein the City Manager may accept applicable grants without Council approval.

WHEREAS, the City Council establishes budgetary policies and priorities through the development of a Citywide Business Plan, adopted annually by the City Council by November 1st each year; and
WHEREAS, the Citywide Business Plan includes a five-year capital improvement plan identifying city-wide project funds from capital improvement sales taxes or from general obligation bonds, which have been scored and vetted through the City’s capital improvement program; and
WHEREAS, the five-year plan is developed utilizing the Capital Asset Rating System adopted by the City Council through Committee Substitute for Ordinance No. 220484; and
WHEREAS, unanticipated situations arise during the course of a fiscal year, such as changes in federal and state programs, whereby the City has opportunities to receive grants that require matching funds from capital improvement sales taxes and general obligation bond projects; and
WHEREAS, encumbering substantial matching funds outside of the five-year capital improvement plan development process causes structural imbalances in the City’s capital improvement funds and general obligation bond programs, which may further cause active capital projects to be delayed or cancelled; and
WHEREAS, the City desires to retain some flexibility to quickly accept or apply to grants that may expire or otherwise become unavailable before the City Council has an opportunity to review and approve such grants; and
WHEREAS, in order to maintain a capital improvement plan which reflects the policies and priorities of the City Council and which has been developed with public engagement and comment, any unbudgeted application for grants requiring substantial matching funds from capital improvement sales taxes or general obligation bond funds should be discussed and approved by the City Council prior to grant submission or acceptance; NOW THEREFORE
BE IT RESOLVED BY THE COUNCIL OF KANSAS CITY:
Section 1. That prior to applying or accepting any grants which require matching funds in excess of one million dollars ($1,000,000.00) from capital improvement sales tax funds or from general obligation bond funds, the City Manager shall submit to the City Council a resolution expressing the City Council’s support for the grant, the anticipated source of matching funds, and the amount of required matching funds.
Section 2. That in instances where a grant application or acceptance window would expire or otherwise become unavailable prior to the Council’s ability to adopt a resolution as described in Section 1, the City Manager may preliminarily authorize the application to or acceptance of such grants without Council approval, and in compliance with all other applicable City Ordinances and Administrative Regulations. The City Manager shall, upon application to a grant or acceptance of a grant award under this Section, submit a resolution as described in Section 1 for review by the City Council at its next scheduled meeting.
Section 3. That in instances where the City Manager’s proposed resolution is not approved by the City Council, the Manager shall withdraw the application or external request for funding.
