Directing the City Manager to execute a Second Amendment to Development Agreement with the Tax Increment Financing Commission of Kansas City and UA KC Southpointe, LLC, for development of property located at 63rd and Prospect.

WHEREAS, Committee Substitute for Ordinance No. 210566 authorized the City Manager to execute a development agreement and amendments with the Tax Increment Financing Commission of Kansas City (“TIF”) and UA KC Southpointe, LLC (“UA KC”); and

 

                     WHEREAS, the City, TIF, and UA KC executed a First Amendment to Development Agreement in July 2023; and

 

                     WHEREAS, UA KC now seeks to amend its construction schedule from twenty-four months to thirty months; NOW, THEREFORE,

 

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section 1. That the City Manager is directed to execute a Second Amendment to Development Agreement with TIF and UA KC Southpointe, LLC, amending the construction schedule for Subdivision 1 parcels from twenty-four to thirty months. A copy of the second amendment in substantial form is attached hereto.
