Authorizing the renewal of a Cooperative Agreement for Water Purchase between the City of Kearney, Missouri and Kansas City, Missouri, for a period of twenty-five (25) years.

WHEREAS, City Council passed Ordinance No. 001021 on August 20, 2000, authorizing a Water Purchase Agreement between the City of Kearney, Missouri and the City of Kansas City, Missouri; and
WHEREAS, the City of Kearney, Missouri desires to renew its current Water Purchase Agreement to purchase water from Kansas City, Missouri; and
WHEREAS, the City of Kearney, Missouri has expressed a future need to increase its water demand from the current contract maximum quantity of 2.9 million gallons per day to a future maximum quantity of 3.6 million gallons per day (MGD), allocated to one point of service; and
WHEREAS, this increased water demand is based on the City of Kearney, Missouri's Drinking Water Master Plan developed in December 2023; and
WHEREAS, Kansas City, Missouri would be able to supply the water demand of 3.6 million gallons per day (MGD) in the future with the understanding that pipeline infrastructure may need to be upgraded to accommodate this request at the City of Kearney's expense; and
WHEREAS, Kansas City, Missouri is willing to deliver and sell water to the City of Kearney, Missouri in accordance with the terms and conditions set forth herein; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the Director of Water Services is hereby authorized to execute, on behalf of Kansas City, a renewal for a Cooperative Agreement for Water Purchase between the City of Kearney, Missouri and Kansas City, Missouri, for a period of twenty-five (25) years. A copy of the agreement is on file in the office of the Director of Water Services.
