Authorizing the Director of Public Works to execute a license agreement with Kansas Fiber Network for a term of ten (10) years with one option to renew for an additional five (5) years to install fiber conduit within the right-of-way and authorizing the Director of Public Works to execute a Communications Easement Agreement with Kansas Fiber Network, LLC.

WHEREAS, Kansas Fiber Network, LLC desires to install fiberoptic lines and associated facilities equipment on City-owned land abutting the Missouri River and within City’s right-of-way; and
WHEREAS, the City desires to authorize the same to increase access to communications services on both sides of the Missouri River and enter into such agreements that may allow for the installation, maintenance, repair, and removal of such lines and equipment; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the Director of Public Works is authorized to execute a license agreement with Kansas Fiber Network, LLC for the installation of fiberoptic lines and associated facilities and equipment within the City’s right-of-way. A copy of said license agreement is on file with the Director of Public Works.
Section 2. That the Director of Public Works is authorized to execute a communications easement for the benefit of Kansas Fiber Network, LLC. A copy of said communication easement is on file with the Director of Public Works.
