Authorizing the Director of Public Works to execute $9,138,372.50 construction contract with J.M. Fahey Construction Company for Street Resurfacing from 63rd Street to South City Limits; authorizing the Director of Public Works to increase this contract by up to thirty percent (30%) without further Council approval; and recognizing this ordinance as having an accelerated effective date.

BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the Director of Public Works is hereby authorized to execute a contract with J.M. Fahey Construction Company in the amount of $9,138,372.50 from previously appropriated funds for Project Number 25-3 - 89008533 - Contract Number CS250029 street resurfacing from 63rd Street to South City Limits. A copy of the contract is on file in the office of the Director of Public Works:
AL-3526-897701-B-89008533 Street Resurfacing $5,000,000.00
26-3090-897701-B-89008533 Street Resurfacing 4,138,372.50
TOTAL: $9,138,372.50
Section 2. That the Director of Public Works is hereby authorized to amend this contract and to increase the amount of the contract by up to thirty percent (30%) without further Council approval.
Section 3. The Civil Rights and Equal Opportunity Department (CREO), to assure fair representation by socially and economically disadvantaged groups, approved for this project, a ten (10) percent representation by Minority Owned Businesses and a ten (10) percent representation by Women Owned Businesses.
Section 4. That this ordinance, relating to the design, repair, maintenance or construction of a public improvement, is recognized as an ordinance with an accelerated effective date.
