Waiving the requirements in Article VII, Section 68-451 of the Code of Ordinances entitled “Sales Tax (adult use marijuana)” for the purpose of reallocating neighborhood cleanup funds to homelessness response efforts; reducing appropriations of the Marijuana Sales Tax Fund (2190) by $485,424.00 and reappropriating the same for the purpose of supporting the Extreme Weather Program; and recognizing this ordinance as having an accelerated effective date.

WHEREAS, the Housing Department has reported a need for an additional one million ($1,000,000.00) for cold weather operations, providing additional shelter beds per night during the cold weather months; and

WHEREAS, Article VII, Section 68-451 of the Code of Ordinances allocates proceeds from the Marijuana Sales Tax; one-third for neighborhood cleanup via the Public Works Department, one-third for homelessness response efforts via the Housing Department, and one-third for violence prevention via the Health Department; and

WHEREAS, the FY 2026-27 first quarter analysis has determined that the allotment for neighborhood cleanup is projected to have unexpended funds of $485,524.00 that can be transferred to the Housing Department; and

WHEREAS the FY 2026-27 first quarter budget analysis has determined that the remaining $514,476.00 will come from the Housing Department’s previously appropriated funds in the General Fund and Marijuana Sales Tax Fund; and

WHEREAS, the City Council desires to reallocate revenue from the Marijuana Sales Tax that will result in a proportional use of proceeds beyond the one-third allotment prescribed by Section 68-451, Code of Ordinances; and

WHEREAS, the FY 2026-27 first quarter budget analysis has determined an appropriation to support this directive will require a transfer of appropriations between the Neighborhoods and Housing Departments in the Marijuana Sales Tax Fund; NOW, THEREFORE,
