COMMITTEE SUBSTITUTE
Waiving the limitations established by the Fund Balance and Reserve Policy in Section 2-1954 of the Code of Ordinances; appropriating $3,830,000.00 from the unappropriated fund balance of the General Fund for the construction of a Temporary Modular Jail Facility; directing the City Manager to include a request for appropriation in the FY27 submitted budget from the Public Safety Sales Tax Fund in the amount of $3,830,000.00 as a transfer to the General Fund; authorizing the Director of General Services to execute change order number 1 for contract EV-4711 in an amount up to $3,480,559.00 with Brown & Root Industrial Services; waiving Section 3-71 of the City's Code of Ordinances which requires new city facilities of a certain size to meet the LEED Gold Standard for any projects funded by the Public Safety Sales Tax, including but not limited to, the Front Street Detention Facility project, the Permanent Detention Facility project, the Community Resource Center project, and the Central Patrol Police Facility project; and recognizing this ordinance as having an accelerated effective date.

WHEREAS, Ordinance No.250890 appropriated $22,000,000.00 from the Unappropriated Fund Balance of the Public Safety Sales Tax Fund for the construction and design professional services of a Temporary Modular Jail Facility; and

WHEREAS, final estimated construction costs for the Front St Detention Facility are estimated to total an additional $3,480,599.00; and

WHEREAS, given the accelerated schedule and time constraints associated with this project and others it is recommended that the city's LEED requirements be waived for this project and any other projects funded by the Public Safety Sales Tax, including but not limited to, the Permanent Detention Facility project, the Community Resource Center project, and t...
