Establishing Fund No. 3448, the Special Obligation Series 2023B City Projects Fund in the records of the City of Kansas City and the Kansas City Police Department; estimating revenues in the amount of $19,072,000.00 in Fund No. 3448, the Special Obligation Series 2023B City Projects Fund and appropriating the same; designating requisitioning authorities; authorizing the Director of Finance to close project accounts upon completion; and authorizing the City Manager to execute an Agreement with the BOPC to outline the framework under which the financing for certain radio system equipment can be implemented between the City and Kansas City Board of Police Commissioners.

WHEREAS, KCPD’s officers use portable (hand-held) and mobile (in vehicle) two-way radios to communicate with each other and with Dispatch personnel; and

 

WHEREAS, KCPD’s current two-way radio system is near the end of its useful life; and

 

WHEREAS, the current equipment is no longer being serviced by the manufacturer, and replacement parts (including batteries) are no longer available; and

 

WHEREAS, KCPD represents that the new Computer Aided Dispatch System will allow KCPD to improve response time to 911 Callers, and get more accurate information about critical incidents; and

 

WHEREAS, to minimize the acquisition cost, the radios and new Computer Aided Dispatch System will be purchased through a regional buying cooperative established by the Mid-America Regional Council and known as the Kansas City Regional Purchasing Cooperative; and 

 

WHEREAS, the acquisition cost of radios and the new Computer-Aided Dispatch System is expected to be a not to exceed amount of $19,071,066.71; and

 

WHEREAS, Missouri Law requires the Kansas City Board of Police Commissioners (BOPC), acting through the Kansas City Missouri Police Department (KCPD) to submit an annual budget request to the City; and

 

WHEREAS, the KCPD has identified funding in its submitted FY 24 budget to cover the first-year cost of financing for the project and the BOPC has the opportunity to enter into an agreement whereby the BOPC can demonstrate that they have no intention to enlarge the responsibility of the Kansas City taxpayer to fund KCPD operations beyond that which is required by state law; and                     

 

WHEREAS the BOPC next meets on December 10, 2022 and has the opportunity to consider this proposal prior to the end of the calendar year; and

 

WHEREAS, the cost of the project is anticipated to be funded with the issuance of special obligation bonds in Spring 2023 and the payment of scheduled debt service payments on the bonds will be made by annual appropriation of monies from general municipal revenues over a successive ten (10) year period, with the funds from the budget of the Kansas City, Missouri Police Department as the primary source of repayment; NOW, THEREFORE,

 

   BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:

 

Section   1.                      That Fund No. 3448 is hereby established as the Special Obligation Series 2023B City Projects Fund in the records of the City of Kansas City, Missouri, and the records of the Kansas City Police Department.

 

Section   2.                       That the revenue in the following account of Fund No. 3448, the Special Obligation Series 2023B City Projects Fund, is hereby estimated in the following amount:

Section   3.                       That the sum of $19,072,000.00 is hereby appropriated from the Unappropriated Fund Balance of Fund No. 3448, the Special Obligation Series 2023B City Projects Fund, to the following account:

Section   4.                       That the revenue in the following account of the KCPDU Fund No. 3448, the Special Obligation Series 2023B City Projects Fund, is hereby estimated in the following amount:

Section   5.                       That the sum of $19,072,000.00 is hereby appropriated from the Unappropriated Fund Balance of the KCPDU Fund No. 3448, the Special Obligation Series 2023B City Projects Fund, to the following account:

Section   6.    That the Director of Finance is designated as requisitioning authority for Account No. KCMBU-AL-3448-129996 and that the Board of Police Commissioners is designated as the requisition authority for Account No. KCPDU-AL-3448-217013-E-23KCPD.

 

Section 7.                      That the City Council hereby declares its official intent to reimburse itself for certain expenditures made within sixty (60) days prior to or on and after the date of this Ordinance with respect to appropriations in Section 3 and Section 5 (collectively the “Appropriations”) with the proceeds of bonds expected to be issued by the City. The maximum principal amount of bonds expected to be issued for the Appropriation is not to exceed $19,072,000.00. This constitutes a declaration of official intent under Treasury Regulation 1.150-2.

 

Section   8.                      That the Director of Finance is hereby authorized to close project accounts, encumbrances and retainage related to the accounts in Section 3 and Section 5, and return the unspent portion to the fund balance from which it came upon the earliest of: (i) Project’s completion; (ii) final maturity of financing, or (iii) five years after issuance.

 

Section 9.  That the City Manager is authorized to execute an Agreement with the BOPC to outline the framework under which the financing for certain radio system equipment can be implemented between the City and BOPC, specifically memorializing that the cost of financing will be included in the Board’s annual budget request from the general revenue obligation of the City and credited to the City’s benefit.
