Dedicating a portion of City-owned real estate for public right of way, north of East 63rd Street from the east right of way line of Brooklyn Avenue, east to the west right of way line of Prospect Avenue, for Project Number 89008711, Southpointe Development - 63rd Street Reconstruction - Brooklyn Avenue to Prospect Avenue all in Kansas City, Jackson County, Missouri; and directing the City Clerk to record this ordinance in the Recorder’s Office of Jackson County, Missouri.

WHEREAS, the council finds that the dedicating of City-owned property along 63rd Street as public right of way is necessary for future development and the public good; and
WHEREAS, City-owned real estate located north of East 63rd Street from the east right of way line of Brooklyn Avenue, east to the west right of way line of Prospect Avenue is needed for said public right of way as part of Project Number 89008711, Southpointe Development - 63rd Street Reconstruction - Brooklyn Avenue to Prospect Avenue; NOW, THEREFORE,
BE IT ORDAINED BY THE COUNCIL OF KANSAS CITY:
Section 1. That the City hereby dedicates real estate hereinafter described for public right of way:
Tract 1 - 6235 Brooklyn Avenue
All that part of Lot 99, Beachwood, A subdivision in Kansas City, Jackson County, Missouri, DESCRIBED AS FOLLOWS:
Beginning at the Southeast Corner of said Lot 99; thence N86 Degrees 58 Minutes 41 Seconds W, along the south line of said Lot 99 and the north right-of-way line of 63rd Street, 132.64 feet, to the southeast corner of new right-of-way conveyed by document 1990-K-0930339; thence North 02 Degrees 15 Minutes 37 Seconds East, along the east line of said new right-of-way, 5.00 feet; thence North 86 Degrees 58 Minutes 41 Seconds West, along the north line of said new right-of-way line, 5.00 feet, to the west line of said Lot 99 and the east right-of-way line of Brooklyn Avenue; thence North 02 Degrees 15 Minutes 37 Seconds East, along said west line, 16.00 feet; thence South 86 Degrees 58 Minutes 41 Seconds East 137.64 feet, to the east line of said Lot 99; thence South 02 Degrees 15 Minutes 37 Seconds West, along said east line, 21.00 feet, to the Point of Beginning, containing 2,865 square feet, more or less.

Section 2. The Dedication shall be used by Kansas City for future street improvements and any necessary appurtenances; and Kansas City and its agents shall have the right to enter upon the Dedication for the purpose of constructing, reconstructing, maintaining, operating and repairing existing and future public improvements or making connections thereto.
Section 3. That upon the effective date of this ordinance the City Clerk is hereby directed to cause this ordinance to be recorded in the office of the Recorder of Deeds for Jackson County, Missouri.
